  • Review the High Commissioner’s report on sexual orientation and gender identity, and consider implementing the recommendations.

There were no references to sexual orientation or gender identity in any of the three input reports.

Recommendations were made on SOGI issues by the United States and Argentina.

IV. Conclusions and/or recommendations
The following recommendations were rejected by the UAE:

128.135. Protect the human rights of all individuals, including LGBT individuals, and take appropriate steps to help ensure that protection is provided to the victim and perpetrators are identified and prosecuted (United States of America);

128.136. Repeal the criminalization of sexual relations between persons of the same sex (Argentina).

V. Adoption of the Report
The draft report of the Working Group was adopted at the 23rd session of the Human Rights Council in June 2013.

Response of the State under review

The UAE is pleased to announce that it has accepted 100 recommendations, partially accepted 7 recommendations, taken note of 50 recommendations and rejected 19 recommendations. The latter are recommendations to which the State is not in a position to comply with at this stage, because their incompatibility with the application of the provisions of the Islamic Sharia or the national constitutional and legal legislation, or their inconsistency with the value and civilizational system of the UAE society are not considered to be within the universally agreed basic principles of human rights.
