Constitutional and legislative framework

16. MPV recommended Sudan to repeal laws criminalizing homosexuality and private sexual conduct between consenting adults and ensure that LGBTI individuals are not arrested on grounds of sexual orientation and/or gender identity.

Equality and non-discrimination

25. MPV noted that LGBTI citizens face several forms of discrimination. Homosexuality is punishable under Sections 148 and 152 of the Penal Code. Death penalty is the punishment for sodomy and is still being enforced in Sudan. They recommended Sudan to promote the rights and freedoms of all LGBTI citizens. They recommended Sudan to provide training to prevent discrimination against LGBTI people.

It urged the Sudan to amend legal provisions that are discriminatory or have a discriminatory effect. […]

V. Conclusions and/or recommendations
Sudan noted the following recommendations:

141.17 Adopt measures in the legislative and political spheres, including appropriate budget allocation, to guarantee, prevent and eradicate discrimination on religious grounds, ethnic composition, gender or sexual orientation (Honduras);

141.21 Push forward for the elimination of discriminatory provisions affecting lesbian, gay, bisexual, transgender and intersex persons (Chile).
