SUMMARY SOGIESC issues during Libya’s 1st UPR review |
I. SOGIESC issues/recommendations identified by NGOs
Right to privacy, marriage and family life
17. ARC joint submission recommended that Libyan Arab Jamahiriya bring its legislation into conformity with its international human rights obligations by repealing all provisions which criminalised sexual activity between consenting adults outside marriage.
18. AI noted that consensual sexual relations outside of wedlock were criminalized in the Libyan Arab Jamahiriya. Article 407(4) of the Penal Code stated that “Anyone who has sexual intercourse with another person with their consent shall be punished, as shall their partner, by up to five years’ imprisonment.” Article 408 (4) also stated that “Anyone who commits an indecent act on another person with their consent shall be punished, as shall their partner, by imprisonment.”
